Easy Couriers – Terms and Conditions of Service
1. Acceptance of These Terms

By using any shipping, courier, forwarding, or related services (“Services”) offered by Easy Couriers or any of its authorized franchise or partner locations, you agree to be bound by these Terms of Service. No signed acknowledgment is required for these Terms to be effective. Once sent or made available to the customer—whether by email, printed receipt, or verbal acknowledgment in store—they are deemed accepted and enforceable. These Terms of Service, along with our Privacy Policy (available at www.easycourier.ca), are published for full visibility and transparency. Any shipment processed through Easy Couriers or its franchise partners is automatically subject to these Terms. We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting. It is the customer’s responsibility to review these Terms periodically.

2. Definitions

Carrier means any third-party shipping company (such as UPS, DHL, FedEx, Purolator, Canpar, Loomis Express, Blue Dart, or others) used by Easy Couriers to transport goods. Shipment means any parcel, envelope, document, package, or pallet accepted by Easy Couriers for forwarding through a Carrier. Shipper means the person or entity delivering goods to Easy Couriers for shipment. Consignee means the person or entity designated to receive the Shipment. Shipping Label means the label issued by Easy Couriers showing the Carrier, tracking number, and destination details. Accessorial Charges include all extra costs beyond standard shipping, such as residential surcharges, fuel surcharges, delivery re-attempt fees, customs fees, or handling charges. Extra Charges refer to any additional fees incurred after shipment dispatch, including customs, storage, address correction, or return charges. Partners/Vendors means companies or logistics providers with whom Easy Couriers collaborates to complete shipments. Definitions may be updated from time to time without notice. It remains the customer’s responsibility to contact Easy Couriers for clarification if any term is unclear.

3. Partner Carriers and Liability

Easy Couriers acts strictly as a forwarding agent and intermediary between the customer and the selected Carrier. The physical transportation of goods is carried out by third-party Carrier companies. The list of partner Carriers (including but not limited to UPS, DHL, FedEx, Purolator, Canpar, Loomis Express, and Blue Dart) is updated periodically. Customers will be informed of the Carrier used for their shipment at the time of dispatch or upon issuance of the shipping label. Each Carrier has its own terms, refund policies, and service guarantees that govern shipments handled by them. It is solely the customer’s responsibility to review those Carrier policies directly on their official websites. Easy Couriers shall not be held liable for delays, loss, or damage caused by the Carrier, any failure of the Carrier to meet its delivery standards, or any discrepancy between Carrier policy and customer expectation. In the event of a conflict between the policies of Easy Couriers and those of the Carrier, the most restrictive policy shall apply.

4. Customer Responsibilities

Customers are required to provide accurate and complete information for both the sender and recipient, including names, addresses, postal codes, contact numbers, and item descriptions. Easy Couriers provides a digital or printed copy of the entered shipment details to the customer by email or in-store receipt. Once this confirmation has been sent, the information is deemed correct unless the customer reports an error within 10 minutes of receipt. Easy Couriers shall not be held responsible for any losses, delays, or misdelivery resulting from incorrect, incomplete, or misleading shipment information provided by the customer. The customer acknowledges that Easy Couriers acts only as a forwarding agent and is not liable for any operational error or negligence on the part of the Carrier.

5. Customs, Export, and Import Compliance

Customs inspections, clearances, and duties are handled solely by the customs authorities of the destination country. Easy Couriers has no control or influence over customs timelines, decisions, or charges imposed. Any delay due to customs clearance, inspection, or governmental hold is entirely beyond our control and does not constitute a service failure. The determination of customs duty, VAT, or import tax lies exclusively with the destination country’s customs authority. Easy Couriers cannot be held liable for any duties, taxes, or penalties assessed. All such charges are the sole responsibility of the shipper or consignee.

While Easy Couriers assists customers in completing customs documentation for convenience, the accuracy and truthfulness of all details remain the shipper’s responsibility. The completed customs form, once prepared, is shared with the customer for full visibility prior to shipment. Any correction or change to the information provided must be communicated in writing or via email within 10 minutes of receiving the copy. After this period, the form is considered final and approved by the customer. The shipper will be charged back for any shipment returned, not cleared for customs, or for any associated return package costs.

It is the customer’s responsibility to ensure that all items shipped comply with export and import regulations of the origin and destination countries. Shipments containing prohibited or restricted items may be seized, delayed, or destroyed by customs without notice. In such cases, Easy Couriers assumes no responsibility or liability for loss, delay, or penalty arising therefrom.

6. Undeliverable and Refused Shipments

If a shipment is refused by the Consignee or cannot be delivered for any reason, the Shipper will be contacted for further instructions. The Shipper is responsible for all charges related to forwarding, disposal, or return of such shipments, including but not limited to return freight, duties and taxes, fuel surcharges, undeliverable shipment fees, storage or disposal costs. If the Shipper fails to provide instructions within two (2) business days, Easy Couriers or the Carrier reserves the right to dispose of or return the shipment at the Shipper’s risk and expense. No refund or compensation shall be issued in such cases.

7. Delivery Times and Service Guarantees

Any delivery timelines provided—verbally, in writing, or displayed on receipts—are estimates only and are not guaranteed. Transit durations may vary based on route, Carrier operations, customs delays, or unforeseen circumstances such as weather conditions, natural disasters, or transportation network disruptions. Customers acknowledge that delivery schedules are subject to the operational capacity of our partner Carriers and other third-party entities. Easy Couriers shall not be held responsible for any delay caused by events beyond its reasonable control, including, but not limited to, adverse weather, accidents, customs inspections, or flight cancellations.

8. Loss, Damage, or Misdelivery

Once a shipment is dispatched and a tracking number has been issued, the package is under the care and custody of the respective Carrier partner. From that point onward, the Carrier’s own policies regarding loss, delay, and damage shall apply. Easy Couriers acts solely as an intermediary and forwarding agent between the customer and the Carrier. In the event of a lost or damaged shipment, Easy Couriers will assist the customer in filing a claim with the Carrier but cannot assume liability for the Carrier’s decision or response time. Customers are encouraged to declare the true and original value of their goods at the time of booking to ensure proper assessment for customs and insurance purposes. Failure to declare the correct value may result in limited or denied compensation from the Carrier in the event of loss or damage.

9. Payment Terms

All shipments must be prepaid unless otherwise approved by Easy Couriers in writing. Any additional charges, including re-delivery, address correction, customs, or Carrier-imposed fees, will be billed to the customer upon notification. Failure to pay outstanding charges may result in suspension of services and recovery action, including collection costs and legal fees.

10. Limitation of Liability

Easy Couriers’ total liability, under any circumstance, shall not exceed the lesser of the declared shipment value or $100 CAD. Easy Couriers is not liable for consequential damages, including loss of income, business interruption, emotional distress, or reputational harm. Claims for loss or damage must be reported in writing within 7 days of delivery (or expected delivery date). Easy Couriers is not responsible for acts or omissions of third-party Carriers or their agents, delays due to customs clearance, shipments seized or destroyed by authorities, or misrepresentation by the customer.

11. Force Majeure

Easy Couriers shall not be held responsible or liable for failure or delay in performing its obligations if such delay or failure results from causes beyond its reasonable control, including but not limited to natural disasters, severe weather, acts of government or customs authorities, transportation failures, strikes, or civil disturbances. Any estimated delivery or completion time shall automatically be extended for a period equal to the duration of the event causing the delay.

12. Data Retention

Your personal information will not be stored for longer than necessary for the purposes for which it was collected or as required under applicable retention policies and/or in accordance with applicable law. Our retention policies reflect local statute of limitation periods and national statutory obligations.

13. How We Protect Personal Information

We maintain administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Although we take steps to limit access to our facilities and vehicles to authorized individuals, information that is located on the outside of a package or letter may be visible to others.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Alberta, and any disputes shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.

16. Packaging and Labeling Requirements

Customers are responsible for ensuring that all shipments are properly packaged, sealed, and labeled prior to acceptance. Packaging must be sufficient to protect the contents during handling, transport, and sorting. Easy Couriers shall not be liable for any loss or damage arising from inadequate or improper packaging, including but not limited to the use of non-durable boxes, failure to cushion fragile items, or missing or detached labels. If a shipment is found to be improperly packed or labeled, Easy Couriers reserves the right to refuse acceptance or repackage the shipment at the customer’s expense.

17. Inspection Rights

Easy Couriers reserves the right, without obligation, to inspect any shipment for security, customs, or regulatory compliance purposes. Such inspections may be conducted by Easy Couriers staff, partner Carriers, or government authorities. Inspection does not imply responsibility or assumption of liability for the contents, packaging, or declared value of the shipment.

18. Insurance Coverage

Unless expressly stated in writing, Easy Couriers does not provide automatic insurance coverage for shipments. Customers wishing to obtain insurance must declare the value and request additional coverage at the time of booking, subject to the Carrier’s terms. Failure to declare value or purchase insurance shall be deemed a waiver of coverage, and the shipment will move at the customer’s own risk.

19. Storage and Abandonment

If a shipment is returned, refused, or held at an Easy Couriers facility for more than seven (7) calendar days without instructions, Easy Couriers may consider the shipment abandoned. Easy Couriers reserves the right to dispose of, destroy, or auction the shipment without further notice, and all related charges (including storage fees) shall remain payable by the shipper.

20. Refunds and Adjustments

All payments for courier services are final. Refunds or adjustments may only be issued if a verifiable billing error occurred and must be requested in writing within seven (7) days of transaction. Refunds are not available for delays, loss, or damage caused by third-party Carriers, customs, or circumstances beyond Easy Couriers’ control.

21. Legal Compliance and Indemnity

The customer agrees to comply with all applicable laws and regulations relating to shipping, export control, and data protection. The customer further agrees to indemnify and hold harmless Easy Couriers, its employees, affiliates, and partners from any claim, damage, loss, or expense arising out of (a) false information provided by the customer, (b) violation of any law, or (c) shipment of prohibited goods.
